Legal fight over golf course

The battle over the future of North Lakes Golf Course land seems destined to go to the Planning and Environment Court.

Developer The Village Retirement Group (TVRG) sought a “variation request” to the Mango Hill Infrastructure Development Control Plan (Mango Hill DCP) to aid its application to build a retirement village and aged care facility on the former golf course land.

However, following a review of the application, Moreton Bay Regional Council said it could not be accepted in that form.

Council and the applicant were then unable to reach agreement on the “type and form” of development application, though this was a not a refusal of the development application.

TVRG has now informed Council it will be applying to the Planning and Environment Court for a ruling on, among other things, whether the development application can be made, as submitted, to Council.

Council says it is “disappointed a pathway could not be agree to” but it is in the best interests of all those affected by this development proposal to "seek clear guidance and direction from the court”.
