Terms & Conditions of Entry
These Terms and Conditions (“Conditions”) apply to all social media competitions, prize draws, and giveaways (“Competition”) conducted by Moreton Daily (“Promoter”, “we”, “us”, “our”) across our Facebook, Instagram, and other social media channels. By entering any Competition, each participant (“Entrant”) agrees to be bound by these Conditions and by the decisions of the Promoter, which are final.
These Conditions must be read together with any specific competition post or announcement, which may set out additional or varied terms for individual Competitions. In the event of any conflict, the specific competition post prevails.

— 2. ELIGIBILITY
Competitions are open to Australian residents aged 18 years and over, unless the specific competition post states otherwise.
The following persons are ineligible to enter:
- Employees, directors, officers, and contractors of Moreton Daily;
- Immediate family members (spouse, parent, sibling, or child) of any ineligible person listed above;
- Any person who, at the time of entry, is prohibited by law from participating in a trade promotion lottery.
The Promoter may request proof of identity and/or residency at any time. Failure to provide satisfactory proof within five (5) business days of request will result in disqualification.
— 3. HOW TO ENTER
Entry requirements for each Competition will be set out in the relevant competition post and may include one or more of the following:
- Following our social media account;
- Liking, commenting on, or sharing a specific post;
- Tagging another social media user in the comments;
- Submitting a response, photo, or other content as directed.
Entry is free of charge. No purchase is necessary to enter any Competition. Where a purchase or other consideration is involved in a promotion, a free alternative entry method will always be available and clearly communicated.
Each Entrant may submit one (1) entry per Competition unless the specific competition post expressly permits multiple entries. Multiple entries in breach of this condition will be disqualified.
Entries must be submitted during the competition period specified in the relevant post. Late entries will not be accepted.
Social media platforms (including Meta/Facebook and Instagram) are not sponsors of, or in any way associated with, any Competition conducted by Moreton Daily.
— 4. PRIZE DRAW AND WINNER SELECTION
All Competitions conducted by Moreton Daily are games of chance. The winner is determined by a random prize draw.
Our standard draw process is as follows:
- All valid entries received during the competition period are compiled into a full entry pool.
- Where the total number of valid entries exceeds one hundred (100), the Promoter may reduce the draw pool to a representative random sample of up to one hundred (100) entries drawn from the full entry pool before conducting the final draw. This step is taken solely to facilitate a visual random draw tool (a digital spinning wheel or equivalent), which operates most effectively with up to 100 entries.
- The reduction of the draw pool does not affect the equal probability of any individual entry winning — every valid entry has an equal chance of selection at both the pool-reduction stage and the final draw.
- The final winner is selected by spinning a digital randomisation tool (spinning wheel or equivalent random name selector) from the reduced pool, or directly from the full entry pool if 100 or fewer valid entries are received.
- The draw is conducted by an authorised representative of the Promoter.
The Promoter reserves the right to conduct the draw using any verifiably random method and to have the draw witnessed or recorded where appropriate.
The draw will take place at the date, time, and location specified in the relevant competition post, or as soon as reasonably practicable after the close of entries.
— 5. PRIZES
The prize(s) for each Competition will be specified in the relevant competition post. Prizes are not transferable, exchangeable, or redeemable for cash unless the Promoter expressly agrees in writing.
If a prize (or any component of a prize) becomes unavailable for any reason beyond the Promoter's reasonable control, the Promoter may substitute a prize of equal or greater value.
The Promoter accepts no responsibility for any costs associated with accepting a prize, including without limitation any travel, transport, or ancillary costs, unless expressly stated.
All prizes are subject to any terms and conditions imposed by the relevant prize supplier.
Where the total value of a prize exceeds $1,000, the winner's name will be published on the Moreton Daily social media channels and/or website for a period of at least 28 days following notification of the winner, in accordance with Queensland trade promotion requirements.
— 6. WINNER NOTIFICATION AND CLAIMING A PRIZE
Winners will be notified by the Promoter via the social media channel used to enter the Competition (for example, by a comment tag, direct message, or equivalent method) within five (5) business days of the draw.
It is the Entrant's responsibility to ensure their account is set to allow messages from the Promoter. The Promoter takes no responsibility for notifications that are not received due to an Entrant's privacy or message filter settings.
Winners must respond to the notification and provide any required information (including delivery details) within fourteen (14) days of notification. If a winner cannot be contacted, fails to respond within this period, or is found to be ineligible, the Promoter reserves the right to draw an alternative winner from the remaining valid entries using the same draw process.
Prizes will be delivered or made available to winners within thirty (30) days of the winner confirming their details, unless otherwise specified.
— 7. CONDUCT AND GENERAL CONDITIONS
By entering a Competition, each Entrant:
- Confirms they have read and agree to these Conditions;
- Confirms they meet all eligibility requirements;
- Consents to the Promoter using their name and social media handle to announce them as a winner;
- Agrees not to submit any entry that is unlawful, offensive, harmful, defamatory, or in breach of any third party's rights;
- Acknowledges that social media platforms used to conduct the Competition are not responsible for the Competition in any way.
The Promoter reserves the right to disqualify any Entrant who:
- Tampers with the entry process or the operation of the Competition;
- Submits entries using automated means, bots, or scripts;
- Acts in a manner that is dishonest, misleading, or contrary to the spirit of these Conditions;
- Provides false or misleading information in connection with their entry.
The Promoter reserves the right to cancel, modify, or suspend a Competition at any time without prior notice if circumstances arise that are outside the Promoter's reasonable control, including but not limited to technical failures, fraud, or changes to applicable law. In the event of cancellation, the Promoter will make reasonable efforts to advise entrants.
— 8. PRIVACY
The Promoter collects personal information from Entrants for the purpose of administering Competitions and, where relevant, announcing winners. By entering a Competition, each Entrant consents to the collection, use, and disclosure of their personal information for these purposes.
Personal information collected in connection with Competitions is handled in accordance with the Australian Privacy Act 1988 (Cth) and the Promoter's Privacy Policy, available at moretonbay.news.
The Promoter will not share personal information with third parties except as required to administer a Competition (for example, with a prize supplier) or as required by law.
Entrants may request access to, or correction of, their personal information by contacting the Promoter through the website.
— 9. SOCIAL MEDIA PLATFORM DISCLAIMER
Each Competition is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, Meta Platforms Inc., or any other social media platform. Any information provided by Entrants is provided to the Promoter and not to any social media platform. All enquiries, complaints, or claims related to a Competition must be directed to the Promoter, not to any platform.
— 10. LIABILITY
To the maximum extent permitted by applicable law, the Promoter excludes all liability for:
- Any loss or damage suffered as a result of participating in, or being unable to participate in, a Competition;
- Any technical failures, delays, or errors affecting entry, draw, or notification processes;
- Any loss of or damage to a prize in transit;
- Any tax liability incurred by a winner in connection with a prize.
Nothing in these Conditions limits or excludes any rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law.
— 11. GOVERNING LAW
These Conditions are governed by the laws of Queensland, Australia. Each Competition is conducted in accordance with the Charitable and Non-Profit Gaming Act 1999 (Qld), the Gaming Machine Act 1991 (Qld), and the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
As Moreton Daily is based in Queensland — a jurisdiction that does not require a trade promotion lottery permit — no permit is required for Competitions conducted by the Promoter where all other applicable conditions are met. Entrants from other Australian states and territories should be aware that local permit requirements may apply; however, the Promoter's obligations under this clause are assessed from Queensland.
Any disputes arising in connection with a Competition will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
